In a recent High Court case, Ras Medical Ltd t/a Auralia Cosmetic Clinic sought discovery from the Medical Council during judicial review proceedings. A patient attended the Clinic and was examined by an unregistered doctor, leading to a complaint and referral to the Preliminary Proceedings Committee. The Clinic sought documents to prove bias and unfairness in the Council’s decision-making process. However, the Court ruled that the applicants did not meet the legal threshold for discovery, as the requested documents did not relate to a matter in issue, were not probably relevant, and were not proportionate to the case. The Court’s decision focused on the discovery application, not the substantive matter at hand.
