In a recent England and Wales High Court case, the General Medical Council challenged a decision by a Medical Practitioners Tribunal that a doctor’s fitness to practice was not impaired by misconduct. The doctor had been accused of sexual harassment of female colleagues at a hospital. Despite admitting to some allegations, the Tribunal found his fitness to practice was not impaired. The Court disagreed, quashing the decision and finding the doctor’s fitness to practice impaired. The case was remitted to a new Tribunal for further consideration. The Court also criticized the doctor’s claim that his conduct was not sexually motivated given the evidence against him.
