President Biden declined to veto a product ban that prevents Apple from selling its newest smartwatches, the Series 9 and Ultra 2, in the U.S. This ban was implemented by the ITC to protect medtech company Masimo, which accused Apple of stealing trade secrets related to blood oxygen level measurement technology. Apple has filed an appeal to lift the ban and is requesting a stay until its redesigned smartwatches can be reviewed to see if they still violate Masimo’s patents. This is not the only legal battle between the companies, as Masimo has previously filed a complaint against Apple’s blood oxygen sensor technology and Apple has also filed lawsuits against Masimo and other competitors.
