Federal Judge Halts Dreamers’ Brand-New Access to ACA Enrollment in 19 States

A federal judge in North Dakota has ruled in favor of 19 states challenging the Biden administration rule that allowed DACA recipients to enroll in Affordable Care Act coverage. This ruling prevents DACA recipients in those states from enrolling in or receiving subsidies for ACA plans. The Biden administration is likely to appeal the decision, which could lead to a final resolution after the Trump administration comes into office. The ruling does not appear to be retroactive, leaving uncertainty about the coverage of current DACA enrollees in those states. DACA was established in 2012 to protect unauthorized residents brought to the US as children.
