Consultant brought Judicial Review proceedings against the HSE

Dr. Edmond Holland, a consultant psychiatrist, brought Judicial Review proceedings against the HSE regarding his retirement age and entitlement to pension. The High Court ruled that there was no unlawful age discrimination in his treatment, as he was required to retire just before his 71st birthday. Dr. Holland was not entitled to further salary after termination and did not respond to multiple offers to join the HSE pension scheme. The Court found that he was aware of his non-membership in the scheme and was not unlawfully excluded. Dr. Holland was, however, entitled to a non-pensionable gratuity of over €141,000.
